Die Arbeit behandelt die rechtlichen Fragestellungen des Gasnetzzugangs in Deutschland und in Spanien. Ziel ist es, Unterschiede aber auch Gemeinsamkeiten der Systeme herauszuarbeiten. Hierfür wird zunächst ein Überblick über die geschichtliche Entwicklung der Gaswirtschaft sowie der dazugehörigen Gesetze gegeben. Im Anschluss daran werden die tatsächlichen Strukturen erläutert und strukturelle Unterschiede aufgezeigt. Während Deutschland sein Gas nämlich ausschließlich über Leitungen auf dem Landweg bezieht, wird Spanien größtenteils per Schiff mit LNG versorgt. Aufbauend auf diesen Ergebnissen wird der Anspruch auf Zugang zu den Gasnetzen im Rahmen eines Rechtsvergleiches dargestellt. Abschließend werden die beiden Systeme in den Kontext des dritten Binnenmarktpaketes gesetzt.
