Lint v. Schloredt by Washington Court of Appeals Book Summary
Attorney Gary W. East (East) initiated a non-judicial trustee sale against his client to recover delinquent legal fees. The client, Robert S. Lint (Lint), obtained a temporary restraining order of sale and the court forced him to deposit monthly interest payments and a surety deposit. Lint dropped the action to restrain the sale. The court distributed the interest payments and the surety deposit to East, but declined to award attorney fees beyond the funds deposited. The retainer agreement does not provide for attorney fees, except after arbitration. But we find that East is entitled to attorney fees, under the deed of trust, pursuant to RCW 61.24.130(1)(b). The trial court misapplied the funds in the court registry and failed to enter findings as to the reasonableness of the fee claim. We therefore reverse and remand for findings and award of fees.
