Mccollum Et Al. v. Bass Et Al. by Supreme Court of Georgia Book Summary

Mitchell W. Bass and Robert L. Bryant, in their application for leave to file an information in the nature of quo warranto, alleged that they are citizens and residents of the 31st District G. M. of Camden County, are taxpayers and patrons, or prospective patrons, of the common-school system of said county, and interested in the conduct of the school system and the expenditure of funds. They asked leave to file, in behalf of themselves and others, an information in the nature of quo warranto, wherein the petitioners challenged the right of Roy R. McCollum Jr. and S. C. Sheffield, as respondents, to hold office as members of the Camden County Board of Education. They alleged that the respondents had been selected and appointed to office by the grand jury of Camden County Superior Court at the April Term, 1946, and that the respondents were both residing in the same militia district, namely the 1606th District G. M., and are therefore holding such offices contrary to law. The Judge of the Superior Court of Camden County granted the application for leave to file, and ordered the respondents to show cause why the prayers of the relators should not be granted. The respondents in their answer admitted that they had been appointed as alleged, that they were residents of the same militia district, and that they had qualified and were serving as members of the Board of Education of Camden County, but denied that they had been appointed in violation of law. There being no issues of fact, the case was heard and determined by the Judge, and the appointments of McCollum and Sheffield were declared to be null and void, and their offices vacant. The respondents excepted to this judgment.
