This is an appeal by the Commonwealth of Pennsylvania from the judgment of sentence imposed by the Court of Common Pleas of Philadelphia County, following the conviction of appellee on charges of possession of cocaine and possession of cocaine with intent to deliver. Appellee was sentenced to not less than eighteen months nor more than thirty-six months of incarceration to be followed by two years of probation and a fine of $5000. Herein, the Commonwealth contends that the lower court imposed an illegal sentence when it refused to impose the mandatory minimum sentence provided by 18 Pa.C.S.A. § 7508(a)(3)(ii). We
